New Fair Usage Policy enforced by T-Mobile on Mobile Broadband Users.

Note* I am constantly editing and adding info to this post as I get the information.

**This information applies to anyone purchasing a T-Mobile Mobile Broadband USB Dongle between 2009 and 2011.**

Current speed is capped at around 0.402mb/s

On or around 30th Aug 2013, mobile broadband users logged on to their accounts and found a new restriction in place.
Without any notification T-Mobile decided to restrict an already throttled service to something that is now practically unusable for everyday use by thousands of laptop owners.


The previous FUP clearly states:

For the time being, however, between 4pm and midnight you won't be able to do other heavy usage activities such as watching videos or downloading files. Before 4pm and after midnight your Mobile Broadband service will continue to run as normal.


This FUP is still active on T-Mobiles website (07/08/2013) and you are redirected to it each time when connecting.

The actual redirection url is ...

..which results in a 404, remove the 
&ts=1375870754 and the page loads.

T-Mobile and its Full Monty service told off over unlimited claims.

The T-Mobile Full Monty tariff is enjoyed by many heavy mobile broadband users, who have absorbed the lifestyle advertising that says you can do things like watch films and stream music all the time using mobile broadband, even if it is on the older 3G and its numerous faster variants.
Unfortunately for T-Mobile someone has complained about the £36 per month unlimited Full Monty plan because they felt it was not unlimited and a traffic management policy applied. The ASA adjudication gives a lot of detail about the actual traffic management policy T-Mobile use, which while mentioned in the products terms and conditions does not go into the same level of detail as listed on the ASA website.


T-Mobile backs down on smartphone data cap (2011)

T-Mobile today was forced into a humiliating climbdown as it reversed its plans to cut data allowances for all its users from a maximum of 3GB to 500MB a month. But it warned that the revised plans would apply to any new customers and those upgrading their phones, though not to existing customers.
The reverse came after protests, threats of legal and regulatory action and a day of dithering by the company, which had initially put out the statement announcing the unilateral change in a posting on its company website on Monday.
But late on Wednesday the vice-president of T-Mobile UK, Lysa Hardy, said: "On Monday 10 January 2011 we announced that, in line with the rest of the industry, T-Mobile would be reducing its fair use policy (FUP) for data usage to 500MB a month for all mobile phone customers.

Claims on www.t-mobile.co.uk for mobile phone tariffs stated "... on the Full Monty. Unlimited internet.  Unlimited texts. 2000 minutes to any network.  Just £36 a month ...".  Text underneath stating "What's included?" linked to a pop-up box which included text stating "Our Full Monty plans let you do so much more on your phone. Take a look at our guide below to see what's included and what you'll need to pay for.  Included in Full Monty plans at £36 a month.  UK Internet Including tethering and VOIP calls - Unlimited ... ".

Issue

The complainant challenged whether the claim that the internet was "Unlimited" was misleading and could be substantiated because he understood that T-Mobile operated a traffic management policy.
